Unpaid Invoice — What Now? (Step-by-Step + Templates) — 2026

Your due date has passed. Your client has not paid. What now?

Unpaid invoices are one of the most frustrating parts of freelancing. You delivered the work, but the payment does not come in. Sending reminders can feel awkward, especially with repeat clients.

This guide gives you a practical escalation plan: when to send reminders, how to escalate professionally, what costs you may charge, and how to prevent late payments in the future.

Why clients pay late

Most late payments are not deliberate non-payment.

Common reasons:

  • The invoice gets buried in a busy inbox
  • The client did not receive a clear payment notification
  • The finance team pays in monthly runs
  • There is confusion about scope or amount
  • Temporary cash-flow issues

That is why you start with a friendly reminder, not legal threats.

When can you send a payment reminder?

Legally, you can send a reminder as soon as the payment term has passed.

Example:

  • Invoice date: 1 February 2026
  • Payment term: 30 days
  • Due date: 3 March 2026
  • First reminder: from 4 March 2026

In practice, most freelancers wait 3 to 7 days after the due date.

The escalation ladder: 4 steps

StepTimingToneAdditional charges
Friendly reminder3-7 days after due datePolite, informalNo
Formal reminder14-21 days after due dateProfessional, formalYes (EUR 40 + interest)
Final warning30-35 days after due dateStrict, consequence-basedYes
Collection / court45+ days after due dateLegalYes

Step 1 — Friendly payment reminder

Start friendly and assume the invoice was overlooked.

Template — Friendly reminder

Subject: Reminder invoice [invoice number]

Dear [name],

I noticed that invoice [invoice number] for EUR [amount] (due date: [date]) has not yet been paid. It may have been overlooked.

Could you please transfer the payment before [new date, e.g. within 7 days] to IBAN [your IBAN], quoting invoice number [number]?

For convenience, I have attached the invoice again.

If you have any questions or if payment has already been made, please let me know.

Kind regards,
[Your name]

Important:

  • Stay polite and professional
  • Reattach the original invoice
  • Include a concrete new payment date

Step 2 — Formal reminder

If no payment comes in after 7-14 days, send a formal reminder. This is typically when statutory collection costs can be added.

Template — Formal reminder

Subject: Formal reminder invoice [invoice number] — payment required within 14 days

Dear [name / company name],

Despite my earlier payment reminder sent on [date], I have not yet received payment for invoice [invoice number] of EUR [amount], due on [date].

This is a formal reminder.

Please transfer EUR [amount] within 14 days of this notice to IBAN [your IBAN], quoting invoice number [number].

In accordance with Dutch law, I will charge:

  • Collection costs: EUR 40.00
  • Statutory interest: EUR [interest amount] (from [due date])

Total outstanding: EUR [total amount]

If payment is not received within this period, I will proceed with further legal steps, including transfer to a collection agency or court procedure.

If payment has already been made, please contact me as soon as possible.

Kind regards,
[Your name]
[Your company name]
[KvK number]

How much can you charge?

Invoice amountStatutory collection costs
Up to EUR 2,500EUR 40
EUR 2,500 - EUR 5,000EUR 60
EUR 5,000 - EUR 10,000EUR 90
EUR 10,000 - EUR 200,000EUR 1,425

You may also charge statutory interest from the due date.

Step 3 — Final warning

If the formal reminder does not work, send a final warning and clearly state that you will escalate.

Template — Final warning

Subject: Final warning invoice [invoice number] — collection will follow

Dear [name / company name],

Despite my formal reminder dated [date], I still have not received payment for invoice [invoice number] of EUR [amount].

This is my final warning.

If full payment is not received within 7 days of this letter, I will transfer the case to a collection agency without further notice. All additional costs will be charged to you.

Outstanding amount:

  • Original invoice: EUR [amount]
  • Collection costs: EUR 40.00
  • Statutory interest: EUR [interest amount]
  • Total: EUR [total amount]

Please transfer the total to IBAN [your IBAN], quoting invoice number [number].

Kind regards,
[Your name]
[Your company name]

Step 4 — Collection agency or court

If there is still no payment, you have two options:

Option 1 — Collection agency

A collection agency takes over the case and pursues payment for you.

  • Often works on no cure, no pay
  • Usually costs around 10-25% of the claim
  • Costs are typically recoverable from the debtor

Option 2 — Court procedure

You can apply for a payment order in court.

Choose this especially:

  • For larger amounts (for example above EUR 5,000)
  • If the client disputes the debt
  • If you have strong supporting evidence (contract, emails, delivery proof)

How to prevent unpaid invoices

Prevention is more effective than chasing late invoices.

1. Add an iDEAL payment link

Clients who can pay immediately via a payment button usually pay significantly faster.

2. Use automatic reminders

Automate reminders so every invoice follows a sequence:

ReminderTiming
Friendly reminder3 days before due date
First overdue reminder7 days after due date
Second overdue reminder14 days after due date
Final reminder30 days after due date

3. Use explicit due dates

Use a specific date rather than "within 30 days."

4. Ask for a deposit

For large projects or new clients, consider:

  • 50% upfront, 50% on delivery
  • Or milestone-based payments

5. Include suspension rights in terms

State in your terms that you may pause new work when earlier invoices remain unpaid.

Common mistakes with unpaid invoices

Waiting too long

The longer you wait, the lower your collection chances.

Starting aggressively

An aggressive first email can damage client relationships. Escalate step by step.

Charging costs too early

Collection costs should follow a proper formal reminder path.

Not keeping evidence

Save all invoices, reminders, emails, and chat messages.

Pausing work without communication

If you pause work, communicate this clearly.

Summary

Escalation ladder for unpaid invoices:

  1. Friendly reminder (day 3-7)
  2. Formal reminder (day 14-21)
  3. Final warning (day 30-35)
  4. Collection agency or court (day 45+)

Best prevention:

  • Payment links (iDEAL/Wero)
  • Automatic reminders
  • Clear due dates and deposits
